Karisma Kapoor’s lawyer Mahesh Jethmalani clarified that the actor is not seeking any share of late Sunjay Kapur’s estate for herself.
The lawyer for actor Karisma Kapoor’s children, Samaira and Kiaan Kapur, on Monday told the Delhi High Court that circumstantial evidence clearly suggests their late father Sunjay Kapur’s will is “forged and buried in deep suspicion”.
Senior Advocate Mahesh Jethmalani, appearing for the children of the late businessman from his earlier marriage to Karisma Kapoor, made the submission while challenging the validity of a will allegedly made in favour of Kapur’s third wife, Priya Sachdev Kapur.
“Circumstantial evidence shows clearly that the contents of the will are forged and is buried in deep suspicion,” Jethmalani told the single-judge bench led by Justice Jyoti Singh.
At last week’s hearing, Jethmalani had raised doubts about the origin and storage of the digital file that is said to contain the will. He pointed out that the Microsoft Word document was first created on February 10 and last modified on 7 March, and was stored on the device of Nitin Sharma, a man reportedly close to Priya Kapur and one of the two listed witnesses.
Continuing his arguments on Monday, Jethmalani said, “It defies logic that while on holiday in Goa with his son, Sunjay Kapur would be modifying a will stored on someone else’s device.”
He also noted that no affidavits have yet been submitted by either of the two witnesses. Adding to the suspicion, Jethmalani told the court that metadata from the file on Sharma’s device suggests it originated from a different computer.
“Whether this is the first file, I don’t know. Whether it came from another interested person, I also don’t know. But it is only a file — whether it is the actual will, we do not know. There is acute secrecy among them as well,” he said.
At the previous hearing (October 9), Jethmalani had questioned why a well-educated man like Sunjay Kapur would fail to inform the executor of the will that she had been appointed, calling the situation “highly suspicious.” He even compared Priya Kapur’s role in the dispute to that of “Cinderella’s stepmother.”
Kapur, 53, died of a heart attack on June 12 during a polo match in the United Kingdom.
