A US judge has ordered the man accused of killing conservative activist Charlie Kirk to stand trial for murder, saying prosecutors have presented enough evidence for the case to proceed.

Tyler James Robinson, 23, faces the death penalty in Utah if convicted of allegedly killing Kirk, who was shot in the neck during a rally at a college campus on September 10 last year.

Judge Tony Graf ruled on Tuesday that Robinson was “bound over for trial” following a preliminary hearing where prosecutors and defence lawyers presented their arguments.

Prosecutors pointed to video game chats and text messages they said showed Robinson had killed Kirk because he was “fed up” with the hate allegedly spread by the conservative activist.

Defence lawyers focused mainly on questioning the reliability of DNA evidence that prosecutors said linked Robinson to the weapon used in the killing.

After the judge’s ruling, Robinson pleaded not guilty to the charges, according to US media reports.

Kirk, 31, was killed during an event organised by Turning Point, the conservative youth group he co-founded and which campaigned for US President Donald Trump in the 2024 election. His wife, Erika Kirk, now leads the organisation.

“Today’s decision, which comes nearly a year since Charlie was taken from us, marks an important step in our family’s pursuit of justice for him,” she said in a statement posted on X.

A prominent conservative activist, Kirk had built a large following among young voters and became an influential figure in the movement supporting Trump.

His killing was captured on cellphone video and the footage spread widely online, adding to the national debate over political violence in the country.

The case will now move towards a full murder trial, where prosecutors will have to prove their allegations against Robinson beyond a reasonable doubt.
