IT Ministry said- DPDP Act and its rules have now been fully implemented. Transparency is no longer an option – it has become a necessity.

The Digital Personal Data Protection (DPDP) Act 2023 is now fully implemented in India with rules. The government has notified its rules on 14 November. These rules will strengthen the privacy of common people as well as promote innovation and digital economy.

The DPDP Act was passed by the Parliament on 11 August 2023. It sets out the responsibilities of companies (data fiduciaries) handling digital personal data, while giving individuals their rights.

Parents’ consent required for data of children and disabled people

Parental consent is mandatory for children to have their data used in any form. There will be exemption only in essential matters like healthcare, education or real-time safety. For disabled people who are unable to take legal decisions, consent will have to be taken from their legal guardian, which is verified under the law.

5 most important things about DPDP Act…

  • Can’t take data without consent: Before any company or app collects your personal data, it will clearly tell you what it will be used for. Can’t do this without your permission. Don’t share data if you don’t want to – it’s your right.
  • Data for essential purposes only: Companies can use your data only for what they tell you. For example, the shopping app will be used only for orders, not for marketing. If there is misuse, you can complain.
  • Keep your data under control: You can view your information, correct errors, update it, or have all your data deleted at any time. Companies will have to respond within 90 days.
  • Immediate news on data leakage: If your data is stolen or breached, the company will have to immediately inform you within hours in simple language that you can understand – what happened, what the impact could be and what steps to take. With this you will be able to remain alert.
  • Complaint easy, board digital: If there is any problem, complain to the Data Protection Board online or through the app. It’s free and tracking is easy. If not satisfied, TDSAT can appeal in court. Compliance has been kept easy even for small businesses, so that services do not become expensive.

What about data breaches and complaints?

If a personal data breach occurs, the data fiduciary must immediately inform affected individuals in plain language. Such as the nature of the break, what effect it can have, what steps should be taken and from whom help should be taken.

People have the rights to access, correct, update or erase their data. Nominees will also get these rights. All requests will have to be responded to within a maximum of 90 days. The Data Protection Board for complaints will be digital in which they can be filed and tracked through online platforms and mobile apps.
