The Supreme Court conducted the hearing after receiving reports from states on compliance with solid waste management rules. The court said that those involved in illegal transportation and illegal dumping of waste should be identified. Instructed District Collectors to take strict action against such vehicles and their owners or operators.
The court said that a separate page for solid waste management should be created on the website of every district. Collectors will upload and report on the current status of waste management, improvements being made and photographs of old waste on this page. The deadline for disposal of old waste accumulated over the years will not be extended.
The bench of Justice Pankaj Mittal and Justice SVN has formed a Supreme Court committee to monitor the waste management rules. It will include secretaries of five central ministries, while the member secretary of the Central Pollution Control Board will be the convenor. It will monitor compliance with rules across the country, provide direction and conduct compliance reviews.
Court asked Railways – how will they handle garbage
This order was given during the hearing on the petition of Dr. Subhash Chandra Pandey of Bhopal. Describing the importance of waste management, the Supreme Court referred to Mahatma Gandhi’s statement ‘He who eats without doing physical labour, eats stolen food’.
The court took the Railways under its ambit for the first time. Said- A large amount of garbage is generated every day in railway stations, tracks and platforms. The monitoring committee should take reply from the Railways and tell them what is the arrangement now and what steps will be taken in the future.
Court’s big comment-order in the case
- Waste management cannot be run just as a government scheme, but work will have to be done to change people’s habits.
- For this, its study should be included in schools also. If children are given correct and useful information, they can explain it to people at home also. Collectors should run awareness campaigns by involving schools and homes and make them examples.
- Every person spreads garbage, but everyone wants that only sanitation workers should do the cleaning work. At present, cases are being avoided against people, so that a good and effective system of waste management can be prepared first.
- The law should be such that people are motivated to follow the rules themselves, not just because of the fear of punishment. But the law should not be so lax that people stop taking it seriously.
Ban on transfer of Swachh Bharat Mission officers
The Supreme Court said that officers working on the Swachh Bharat Mission should not be removed from their posts until the target is achieved. According to the court, to ensure that the work continues smoothly, it is necessary for the officers to remain consistent.
If it is necessary to remove an officer, the state government will first have to take permission from the monitoring committee of the Supreme Court and give concrete reasons, such as poor performance or special circumstances.

19 February 2026: Citing ‘Article 21’ of the Constitution, the court had said that it is the fundamental right of every citizen to live in a pollution-free and clean environment. The court had said that more than 1.70 lakh tonnes of solid waste is being generated every day in the country, which is not being disposed of scientifically.
29 April 2026: In this order, the court had directed to remove administrative and financial hurdles. The court had directed the Chief Secretaries of all the states to appear personally and virtually in the hearing on May 5 and present their complete action plan and answers before the court.
