In the Swati Maliwal assault case, the Delhi High Court on Friday (July 2) called the arrest of Delhi CM Arvind Kejriwal’s PA Bibhav Kumar necessary. Justice Neena Bansal Krishna said that the police acted within the ambit of the law. There was sufficient evidence to arrest Bibhav, on the basis of which he was arrested without notice.

With this order, the High Court rejected Bibhav’s petition in which he had demanded to declare his arrest illegal. The order copy of this hearing held on Friday was released on Saturday. An FIR was registered against Bibhav on May 16 and he was arrested on May 18. He has been in jail since then.

In its order, the High Court said that after Bibhav’s arrest, the trial court had heard the arguments of both Bibhav and the state and after that gave the police custody for five days. During this, the court also said that the law does not allow the investigating officer to arrest a person during investigation, but in the present situation, there was sufficient evidence to arrest Bibhav, on the basis of which he was arrested without notice.

The court said that every person has the right to freedom under Article 21 of the Constitution. The law is also designed in such a way that this right is not violated. The facts related to this case make it clear that the arrest was necessary in the current situation and this arrest has been made under Section 41 of the CrPC. On this basis, Bibhav’s petition has no merit, so it is rejected.

The bail hearing was held in the Supreme Court
Earlier on Friday, the Supreme Court heard the bail plea of ​​CM Kejriwal’s PA Bibhav Kumar in the Swati Maliwal assault case. During this, a bench of Justice Suryakant, Justice Dipankar Dutta and Justice Ujjwal Bhuiyan asked whether the Chief Minister’s residence is a private bungalow. We are surprised whether such a goon should work in the CM residence.

The court asked sharp questions to Bibhav’s lawyer Abhishek Manu Singhvi. The bench asked- Bibhav knew the physical condition of the victim, but this man kept beating him. Does he think that power has gone to his head? Despite this, you are still defending him.

The bench has also issued notice to Delhi Police on the petition filed against Bibhav’s bail. Also, the hearing has been postponed till August 7, taking time to read the charge sheet of the case.

Charge sheet with 50 witnesses filed against Bibhav
Earlier on July 30, the hearing on the Swati Maliwal case was held in Delhi’s Tis Hazari Court. On which Metropolitan Magistrate Gaurav Goyal took cognizance of the charge sheet filed on July 16 and listed the case till August 24 for scrutiny of documents.

This 500-page charge sheet contains statements of about 50 witnesses. An FIR was filed against Vibhav on May 16 and he was arrested on May 18. He has been in jail since then.

Before the Supreme Court, Bibhav had filed a bail petition in the Delhi High Court. Hearing on which, on July 12, the High Court refused to grant relief.

Neither did Bibhav have any intention to undress Swati. These injuries could be self-inflicted.
