Mahesh Jethmalani calls Mamata Banerjee’s refusal to resign after losing West Bengal polls unpardonable, urges Governor to dismiss and even evict her.

Speaking on West Bengal Chief Minister Mamata Banerjee’s refusal to resign from the post after losing assembly elections, senior advocate Mahesh Jethmalani called her behaviour “unpardonable” and said it is a “challenge to the whole democratic system”.
Jethmalani made the remarks while speaking exclusively to NDTV. He said that once the Election Commission has certified an election, then a state’s chief minister is bound to resign from his/her post.
He further said that this is “an insult and she deserves to be taught a lesson.
“I’m glad she did this. I’m glad that this is her attitude, so that the Governor can dismiss her instead of her gracefully resigning… the Governor must formally dismiss her because she holds office at his pleasure. If she insists on sticking like a lemming to her chair, then the Governor must unceremoniously dismiss her. I would like to say, given this conduct, kick her out,” he said, while speaking to NDTV.
The senior advocate said that if Banerjee continues to occupy the chief minister’s office, then the Governor can send in the police to “evict her”.
“She is a trespasser in the Chief Minister’s office from now on. The moment the election is certified – election results are certified – she is a trespasser,” he said.

When asked about Banerjee’s allegation that 100 seats in the state had been “looted”, Jethmalani said that she should approach the court for her grievance.
“File individual election petitions for all of them if you have so much evidence. You can waste the time of the court; the court will probably unceremoniously throw you out as well. You have already been given short shrift in the Supreme Court twice before. If you want to keep making yourself a laughingstock, go ahead and do it. You have a constitutional right to move court,” said Jethmalani.
Mamata Banerjee Refuses To Resign From CM’s Post
Banerjee, who lost the state assembly elections to the BJP after coming to power for three consecutive terms, said that she won’t resign from her post.
“I have not lost, so I will not go to Raj Bhavan. I will not tender resignation,” Banerjee said to the reporters in a press conference. She further claimed that the BJP had stolen 100 seats from her party.

Banerjee, who also lost in her Bhabanipur constituency, alleged that the government and the Election Commission joined hands to clinch this “victory”.
West Bengal assembly’s term ends on May 7.
