- Supreme Court Orders Indian Oil Corporation To Pay Compensation To Woman

The Supreme Court has ordered Indian Oil Corporation Limited (IOC) to pay compensation of Rs 12 lakh to Sumitra, a qualified woman candidate. About 38 years ago, IOC had refused to give job saying that ‘women will not be able to lift the cylinder.’
The woman has now reached retirement age. Therefore, instead of giving him a job, the court has decided to give him a compensation of Rs 12 lakh. The bench of Justice Arvind Kumar and Justice Vipul M Pancholi strongly criticized the corporation and said that not giving a job merely on the basis of being a woman is an insult to womanhood.

Sumitra, a resident of Gudha village in Haryana, was among the 49 people recommended by a local committee headed by the deputy commissioner for the post of refilling helper or casual attendant at an LPG bottling plant.
This case is related to a woman living in Gudha village. In the year 1988, his name was included in the list of 49 people who were recommended by the local committee headed by the Deputy Commissioner for the LPG bottling plant of the Indian Oil Corporation.
The woman had given interview for the post of Khalasi, Peon or Refilling Helper. But he did not get the job while others in the list were given appointment letters. After this the woman approached the trial court against the decision of not giving her the job.
The trial court accepted that the woman met the eligibility criteria for the job. The court also cited the statement of a witness, which revealed that the woman was not given the job just because she was a woman.
However, the IOC appealed the trial court’s decision, and on August 6, 1993, the first appellate court overturned the trial court’s decision. After this the matter reached Haryana High Court and then Supreme Court.
Do women not lift gas cylinders at home: Court
Indian Oil’s lawyer had argued that in this work one has to lift heavy LPG cylinders and there is a night shift, hence perhaps the officials did not consider the woman suitable. On this, the court asked the lawyer – Do women not carry gas cylinders in their homes?
The court said- We are from India and talk about respect for women every day. We say that woman is like a goddess. In such a situation, this is an insult to women’s dignity from an undertaking of the Government of India.
