Lok Sabha Speaker Om Birla said in Delhi on Thursday that if the opposition brings a new impeachment motion to remove Chief Election Commissioner (CEC) Gyanesh Kumar from the post, then it will be considered under the rules and procedure. He said that after receiving the notice, it will be investigated. The opposition has so far given notice twice to remove Gyanesh Kumar from the post. For the first time, notices from Lok Sabha and Rajya Sabha were rejected. A decision is yet to be taken on the notice given in Rajya Sabha for the second time. The government may call a special session of Parliament this month. In this, the opposition can bring a proposal to remove Gyanesh Kumar for the third time. Many organizations including the opposition are protesting in different parts of the country alleging irregularities in SIR and demanding the resignation of Gyanesh Kumar. CEC can be removed like a Supreme Court judge. The process of removing Chief Election Commissioner (CEC) Gyanesh Kumar from the post is different from that of ordinary government officials. He can be removed under a special constitutional procedure, just like a Supreme Court judge. For this, it is necessary to pass the proposal in both the houses of the Parliament. The resolution has to be passed by a majority of the total membership of each House and with the support of at least two-thirds of the members present and voting. The ground for removal from office should be proven misconduct or inability to perform. The CEC cannot be removed from office merely by protest or demand for resignation. A three-member committee investigates the allegations. Under the 1968 law related to the removal of judges, the Speaker of the Lok Sabha or the Chairman of the Rajya Sabha can form a three-member investigation committee if the proposal is accepted. It consists of a judge of the Supreme Court, the Chief Justice of the High Court and an eminent expert in the field of law. The committee investigates the allegations and submits a report. Even if the allegations are proved, for removal from the post, a resolution is required to be passed by the prescribed majority in both the Houses of the Parliament. After this the President takes formal action to remove him from the post. ——————————– Also read this news… Government can call a special session of Parliament this month, it is expected to increase Lok Sabha seats and present the delimitation bill.
