If it can be achieved, for how many generations will this protection continue? Justice Anup Jairam Bhambhani said that a trademark is identified because of its product or service. But the identity of a person or family’s name is determined by his achievements, work and his reputation in the society. In such a situation, the question is whether this reputation can also move forward like a family legacy. The court raised three big questions – First question – Can the reputation of the family be passed on to the next generations? The court will see that if the reputation of a family name is treated like a trademark, can this reputation continue to the next generations? If yes, what will be its legal limit? Second question- Is fake news also a violation of intellectual property rights? The court will also see that if extremely objectionable and false news is spread about a celebrity or his family, can it be considered a violation of intellectual property rights? Third question- Can defamation also be linked to intellectual property? The court will try to understand whether defamation that harms a person’s reputation can be brought under intellectual property rights. The court made it clear that these questions are not final and further issues can also be discussed in the case. The legacy of the Bachchan family is also an issue. Advocate Praveen Anand, appearing on behalf of Aaradhya, said that the matter is not just about Aaradhya’s reputation, but about the reputation of the entire Bachchan family. He said before the court that such videos were made using pictures of the Bachchan family and the name ‘Bachchan’, in which false things like Aaradhya’s death or cancer were said. This damaged the reputation of the family. That is why now a big question before the court is whether the name and reputation of a famous family can be considered a legacy and can that legacy be given legal protection? The next hearing will be on September 15. Delhi High Court will hear the next case on September 15. During this, questions related to family reputation, fake news, defamation and personality rights will be discussed further. The decision of this case can be important not only for the Bachchan family but also for other celebrity families. This can help determine how the law protects a family’s name, identity, image and reputation from misuse online.
