A Chinese citizen who exposed the atrocities against Uyghur Muslims in China has got asylum in America. Guan had applied for asylum. The judge said Guan’s life could be in danger if he was sent back to China.

According to the BBC report, Guan Heng had exposed the human rights violations taking place in the Xinjiang region. He secretly filmed detention centers in 2020. Guan reached America illegally in 2021.

He was taken into custody in August 2025. After that he sought asylum from America. Human rights groups say that more than one million Uyghur Muslims and minorities in Xinjiang have been forcibly detained without any legal process.

Uyghur Muslims in China have been struggling for their existence for a long time. Since 2014, the Chinese government has banned Uyghur Muslims working in government jobs from offering namaz in public places and wearing beards.

Video was released before reaching America

Guan took video footage of detention centers in the Xinjiang region and left China for publication. Guan released the video a few days before arriving in the US.

He released most of the videos on YouTube, after which the police in China interrogated his father three times and sought information about him.

Guan reached Florida by boat illegally in 2021 via Hong Kong, Ecuador, Bahamas. He told the court that he knew it would not be safe to release this footage while he was in China.

At Wednesday’s hearing, the judge asked whether he filmed the asylum seeker in detention centers and released the video to him before arriving in the United States.

Guan attended the hearing via video link from a US correctional facility. To the judge’s question he replied that it was not so. “He sympathized with the persecuted Uyghurs,” she said.

Guan’s lawyer said – it is America’s moral responsibility to give asylum

After reaching America, Guan applied for asylum. He was living in America between 2021 and 2025, he had got a work permit. They settled in New York state. There he worked two jobs and was living a normal life.

He was detained in August as part of the Trump administration’s massive deportation campaign. Initially the US Department of Homeland Security was trying to send him to Uganda, but the plan was postponed in December due to a separate case.

Judge Charles Oslander in Napanoch, New York, called Guan a credible witness at the hearing and said he had proven legal eligibility for asylum. Guan’s lawyer Chen Chuangchuang said the issue is an asylum issue and the United States has a moral and legal obligation to protect such people.

However, Guan was not immediately released after the verdict. The Department of Homeland Security has 30 days to appeal.

The Uyghurs are a Turkic ethnic group that lives primarily in Xinjiang. Xinjiang shares borders with 8 countries including Mongolia and Russia. The Uyghur community, which follows the Muslim religion in the region, has long had a contentious relationship with Beijing.

Uyghur Muslims living in Xinjiang province do not consider themselves Chinese. They speak Turkish and consider themselves of Turkish origin. There have been several violent clashes between Uyghurs and Chinese security forces in the region. Due to the harsh policy of the Communist government, thousands of Uighurs have fled and taken refuge in other countries.

It has been said in many reports that Uyghurs working in government jobs can be punished and lose their jobs for not offering namaz five times a day or fasting during Ramzan.

Uyghur women are also prohibited from wearing burqa. The Chinese government had banned keeping beards in 2008. Uyghur women cannot go to petrol stations, banks and hospitals wearing veil. She can’t even do a government job.
