The Calcutta High Court on Thursday granted relief to Trinamool Congress (TMC) MP Abhishek Banerjee from any action for three weeks in the fake signature case. However, the court directed him to cooperate in the investigation. After this, Abhishek reached CID Headquarters Bhavani Bhawan at around 5:50 pm. The court said that for future inquiries, CID will have to give 24 hours notice. At the same time, the matter of appointment of Leader of Opposition of Bengal Assembly was also heard in the Calcutta High Court. TMC and party chief Mamata Banerjee have challenged the decision of the Assembly Speaker in which MLA Ritabrata Banerjee was recognized as the Leader of Opposition and Sandipan Saha as the Chief Whip. In the petition filed by TMC, Shobhandev Chattopadhyay and Mamata Banerjee said that the party had already appointed Shobhandev as the Leader of Opposition and this information was given to the Speaker. Therefore the Speaker should have accepted the party’s decision. Advocate Kalyan Banerjee, on behalf of the petitioners, said in the court that the right to choose the Leader of Opposition lies with the political party, not the legislative party. He said that the Speaker’s decision is against the basic structure of the Constitution. Kalyan Banerjee also said that Ritabrata Banerjee and Sandipan Saha have been expelled from the party, hence their group cannot be considered as a separate legislative party. The High Court has not given any interim order at present and has fixed the next hearing of the case on June 16. The assembly session will start from June 18. This matter is related to the resolution passed in the May 6 meeting of TMC, in which Shobhandev Chattopadhyay was claimed to be nominated as Leader of Opposition and other leaders for several posts in the Assembly. Expelled party MLAs Ritabrata Banerjee and Sandipan Saha alleged that no such resolution was passed and many signatures in the resolution book were fake. Based on these allegations, Kolkata Police had registered a case of cheating, forgery and criminal conspiracy, which was later handed over to CID. The investigating agency says that the original proposal book and attendance register are necessary for forensic examination of signatures. For this reason, summons were sent to Abhishek Banerjee thrice. CID also recently searched Mamata Banerjee’s party office in Kalighat and Abhishek Banerjee’s Kolkata office, but the original documents were not found. Now on one hand the High Court will hear the ongoing dispute regarding the appointment of the Leader of the Opposition, while on the other hand the CID will proceed with the investigation of the signature forgery case. Both MLAs were expelled for complaining about fake signatures. Mamata Banerjee had expelled 2 TMC MLAs Sandipan Saha and Ritabrata Banerjee from the party. Both of them had complained to the Speaker that the party had forged their signatures in the proposal to make Shobhandev the leader of the opposition. Saha and Banerjee allege that both were expelled from TMC only after making this complaint. After this, on May 3, 58 out of 80 party MLAs supported rebel leader Ritabrata Banerjee.
