The Mamata Banerjee-led Trinamool Congress (TMC) faction on Monday filed its detailed reply before the Election Commission (EC), completely rejecting the claims of the rebel group. The party said that all the organizational committees of the All India Trinamool Congress (AITC) are valid till 2027 as per the party constitution and the claim of the rebel group is factually and legally false.

After filing the reply in the Election Commission, TMC MP Kalyan Banerjee said that the party has submitted a detailed reply to the representation given by rebel leader Ritabrata Banerjee. He said that the claim of the rebel group that the tenure of AITC Committee and National Working Committee ended in 2025 is completely false.

Kalyan Banerjee raised questions on the rebel leaders, saying that if they believed that the party was doomed in 2025, then how did they contest the 2026 West Bengal Assembly elections on the TMC symbol and on the basis of nomination papers bearing the signature of Mamata Banerjee. According to him, if the argument of the rebel group is considered correct, then his election will also become illegal and he should resign immediately.

TMC also alleged that the special session organized by the rebel group on June 22 was completely against the party constitution. The party says that according to the Constitution, the organizational process starts from the block level and after the district and state committees, it reaches the National Committee, but the rebel group ignored all these processes. The party alleged that neither a public notice was issued nor necessary notice was given to ex-officio members including MPs and MLAs.

Kalyan Banerjee termed the action of the rebel group as a completely fake process and said that they have also tried to capture the party offices illegally.

Recognition of Leader of Opposition is given on the recommendation of the parent political party: TMC

TMC has also mentioned the history of the party in its reply. The party said it got the “grass-flower” election symbol when it was formed in 1997 and was renamed All India Trinamool Congress in 2000. The party says that the Election Commission has been continuously informed about all the amendments in the Constitution and organizational changes and the Commission has never raised any objection.

The party also claimed that in February this year, a revised copy of the party constitution was submitted to the Election Commission, which was accepted by the Commission. In such a situation, to say that the party committees had ended in 2025 is not factually and legally sustainable.

Citing past conventions of the Assembly, the TMC said recognition of the Leader of the Opposition is given on the recommendation of the parent political party and not merely on the independent decision of the legislature party. The party also said that after the elections, the rebel MLAs themselves had gone to the Assembly Speaker seeking recognition as the AITC legislative party, thereby accepting the existence of the parent organization.

The party also accused the rebel group of impersonating before the Election Commission by posing as authorized officials of AITC and said that the documents submitted by them are not authorized, hence they should be rejected.

The Election Commission has sought claims and responses from both the Mamata Banerjee faction and the Ritabrata Banerjee-led rebel group as authorized signatories and the party’s organizational elections. Last week, the controversy intensified after the rebel group described itself as the “real AITC” before the Election Commission.
