Anyone else seeking permanent residence in the US will have to apply to the American Consulate in their home country. Immigration lawyer Charles Cook said the change is particularly worrisome for people who are married to US citizens and want permanent residence. Such immigrants need to establish their immigration status before obtaining a green card and usually resolve such cases while living in the United States. Cook says this is an effort to slow down immigration and make immigration so complicated and inconvenient that you have to return to your country. Efrain Olivares, vice president of legal strategy at the National Immigration Law Center, says the new policy is aimed at disrupting the green card process. Most applicants are allowed to remain in the US with their families until the green card process is completed, but there will be an exception to remain in the country now. In the past, people with exceptional circumstances, such as having been deported multiple times or having a serious criminal history, were asked to apply from their home country, says Olivares. Some immigrants, speaking on the condition of anonymity for fear of retribution, said they are confused and worried about what the change will mean for their or their partner’s applications. Carla Ostoleja, managing director of Immigration Practice, a non-profit organization that helps immigrants, says the impact of this change will not be felt immediately but will be felt greatly. 1.4 million people will get green cards in 2024. Immigration lawyers and their supporting organizations say that the new rules will reduce green card applications. 14 lakh green cards were issued in 2024. More than eight lakh people who have received the card are already in the US and have had their immigration status changed as part of the process.
