A case has been registered against comedian-actor Kapil Sharma and the producer of his show ‘The Great Indian Kapil Sharma’ for copyright infringement.

This case has been filed in the Bombay High Court on behalf of the Copyright Society Phonographic Performance Limited (PPL).

Along with Kapil Sharma, production companies K9 Films Private Limited and BeingYou Studios Private Limited have been made accused in the case. The society has asked the court to ban the use of copyrighted sound recordings in the show.

The case was listed before a single judge bench of Justice Sharmila U Deshmukh on December 24. The court has sought a reply from the makers of the show, for which they have been given two weeks’ time.

What is the whole matter?

Let us tell you that on December 12, a commercial petition was filed by PPL in the Bombay High Court against Kapil Sharma’s show. Alleging violation of copyright rules, the petition said that in the third season of Kapil’s show, between June and September, 3 licensed songs were used without permission.

  • Rama Ray, film Kaante
  • Don’t let the morning break, film Desi Boys

The copyright of these songs is with PPL India. Using these songs commercially without permission is a violation of copyright law. Only license holders can use these songs.

PPL has demanded in the petition that the unlicensed use of copyrighted songs should be banned as soon as possible. The income earned from its illegal use should be disclosed and material related to the violation should be confiscated.

Before filing the petition on December 12, PPL India had issued a cease and desist notice to Netflix and the makers of The Kapil Sharma Show in early November, but received only evasive responses and the sound recordings are still being shown in the episodes.

It has also been said in the petition that both the makers of The Kapil Sharma Show and Netflix have not taken any permission for this.

It is claimed that the show is first recorded in front of a live audience, at which time the songs are heard clearly. After this, these episodes are edited and streamed on Netflix.
