सोहराबुद्दीन फर्जी मुठभेड़ केस- सभी 22 आरोपी बरी: बॉम्बे HC बोला- ठोस सबूत नहीं, संदेह पर सजा नहीं दे सकते; ट्रायल कोर्ट का फैसला बरकरार

On 23 November 2005, Sohrabuddin, his wife Kausar Bi and companion Tulsiram were kidnapped from a bus.

The Bombay High Court on Thursday upheld the acquittal of all 22 accused in the 2005 Sohrabuddin Sheikh fake encounter case. In this case, Sohrabuddin’s wife Kausar Bi and associate Tulsiram Prajapati were also murdered.

A bench of Chief Justice Chandrashekhar and Justice Gautam Ankhar rejected the appeals of Sohrabuddin’s brothers, Rubabuddin and Nayabuddin. The 22 who have been acquitted were junior level officers of Gujarat and Rajasthan Police.

He was accused of being part of the team that kidnapped all three and later killed them in a fake encounter. The remaining accused was the owner of a farmhouse in Gujarat, where Sohrabuddin and Kausar Bi were held illegally before their murder.

The court made it clear that punishment cannot be imposed on the basis of suspicion without concrete evidence. Amit Shah, IPS DG Vanzara, IAS Rajkumar Pandian and Dinesh MN have already been acquitted in this case.

• 23 November 2005: Sohrabuddin, wife Kausar Bi and Tulsiram were kidnapped from the bus.
• 26 November: Sohrabuddin killed in alleged fake encounter.
• 29 November: Sohrabuddin’s wife Kausar Bi killed in alleged fake encounter.
• December 2006: Eyewitness Tulsiram died in another encounter.
• 2007-2010: On the orders of the Supreme Court, the investigation was handed over to CBI after Gujarat CID.
• 2012-2013: Case transferred to Mumbai for fair hearing. The trials of all three murders were combined together.
• 2014-2017: Senior IPS officers were acquitted due to lack of evidence.
• December 2018: The special CBI court acquitted the remaining 22 as 92 out of 210 witnesses turned hostile.
• 2019-2025: Sheikh’s brothers appealed against the acquittal in the Bombay High Court.
