The Bombay High Court on Thursday questioned how long the city police would continue their inquiry into the death of former celebrity manager Disha Salian, who died in June 2020.
Salian fell from the 14th floor of a residential building in Malad, north Mumbai, on 8 June 2020. The city police had registered an Accidental Death Report (ADR) following the incident.
A bench comprising Justices A S Gadkari and R R Bhonsale noted that five years have passed since the death and all that needed to be determined was whether it was a case of suicide or culpable homicide.
The bench made the remarks after public prosecutor Mankhunwar Deshmukh told the court that the inquiry was still ongoing. “Why still inquiry? It has been five years. Someone has died. You just have to ascertain if it was a suicide or culpable homicide,” the court asked. Deshmukh added that the investigation was being conducted minutely to rule out all possibilities.
The hearing came after Disha’s father, Satish Salian, filed a petition in the High Court in March this year, alleging that his daughter had been gang-raped and murdered. He sought a CBI probe into her death and requested that an FIR be registered against Shiv Sena (UBT) leader Aditya Thackeray. Satish Salian claimed that there had been a politically orchestrated cover-up to protect influential individuals.
During the proceedings, Deshmukh told the court that the police had recorded statements from Satish Salian and his wife on multiple occasions, and they had expressed no suspicion against anyone. “And now after five years, the father is raising these contentions,” she said.
The bench also questioned why the police had not provided Satish Salian with copies of his statements and other documents related to the probe that are legally permissible. “He is the father of the victim. Any document that is legally permissible can be handed over to him,” the court said. It directed the police to produce the post-mortem report and posted the matter for further hearing on 11 December, when the prosecutor will clarify the police’s stance on providing documents.
Earlier, Aditya Thackeray had sought to intervene in the plea, calling the petition “false, frivolous and motivated,” and requested a hearing before any order is passed.
