Meanwhile, the Bombay High Court on Tuesday asked Vijay Mallya when he would return to India. The court said that without coming to India and coming under the jurisdiction of the court, Mallya’s petition will not be heard. Mallya has challenged the Fugitive Economic Offenders Act and the decision to declare himself a fugitive.
Vijay Mallya has been in Britain since 2016 and was officially declared a fugitive economic offender in 2019. At the same time, Lalit Modi has been living abroad since 2010 and faces serious allegations related to tax evasion, money laundering and IPL.

ED’s argument – cannot challenge the law while living abroad
The bench of Chief Justice Shri Chandrashekhar and Justice Gautam Ankhad heard Mallya’s petition. During this, Solicitor General Tushar Mehta, on behalf of the Enforcement Directorate (ED), argued that permission should not be given to challenge the law while living abroad. He told that the process of extradition of Mallya is in the final stage.
Mallya’s lawyer claimed that the financial liability of the banks has been recovered to a large extent, but the court said that criminal liability cannot be extinguished without coming before the court. Now the next hearing of this case will be on February 12.
16 December- New appeal to stop extradition of fugitive Nirav Modi
Earlier on December 16, fugitive diamond trader Nirav Modi had filed a fresh appeal in a London court to stay his extradition. India’s ED and CBI teams are also present in London. She is assisting the Crown Prosecution Service (CPS) to oppose Nirav’s appeal.
Nirav has been declared a fugitive economic offender in India and is wanted to face trial in the Punjab National Bank fraud case. Nirav is accused of fraud of more than Rs 6,498 crore. A British court has already approved his extradition in favor of the Indian government.
