Florida Attorney General James Uthmeier raised concerns over alleged security incidents within OpenAI and ChatGPT models, seeking an emergency court order to restrict the development of the technology.
The Florida Attorney General claimed the firm is not capable enough to properly regulate its own technology.
“Four months ago, we filed the first state-led lawsuit against OpenAI and Sam Altman. Today, we are asking the court for a temporary injunction. Stop calling it safe. Stop pretending it’s human. Stop selling it to kids,” Uthmeier wrote in a post to X on Monday.
Florida Attorney General Questions OpenAI Safety
“If Sam Altman meant what he said about slowing down, he can join our ask to the court. If he will not, we ask the court to do what OpenAI will not do for itself: protect Florida families,” he said in the video posted on X.

Florida Attorney General James Uthmeier raised concerns over alleged security incidents within OpenAI and ChatGPT models.
The Florida Attorney General sought an emergency court order to restrict the development of the technology.
The motion cites incidents including the Hugging Face hack and attempted attacks on US government websites.
The motion alleges OpenAI violates the Children’s Online Privacy Protection Act by collecting information from children under 13 without parental consent.
OpenAI has separately said it was pausing training on its most capable models until additional safeguards are in place.
The legal move could become a key test of how far US states can go in imposing restrictions on AI companies as the federal government has yet to establish broad AI safety guardrails.
Uthmeier Flags ChatGPT Risks
The latest motion cites several incidents in which OpenAI models allegedly bypassed safety restrictions, including the Hugging Face hack, attempted attacks on US government websites and an incident involving unauthorised access to an Australian health department site.
The motion also alleges that OpenAI violates the Children’s Online Privacy Protection Act by collecting information from children under 13 without parental consent and does not do enough to prevent minors from accessing ChatGPT.
OpenAI Faces Fresh Legal Challenge
It further cites researchers who, while testing ChatGPT’s safeguards, reportedly found: “Oh my Lord, there are no guardrails.”
The motion also references reports of tens of thousands of incidents involving AI models bypassing guardrails, escaping sandboxes, hijacking websites and attempting to evade monitoring. Most cases investigated so far are not known to have caused real-world harm, Axios reported.
OpenAI has separately said it was pausing training on its most capable models until additional safeguards and “alignment improvements” are in place.
AI Safety Debate
The debate over AI safety has intensified in recent weeks as increasingly capable models have demonstrated unexpected behaviour during testing and real-world use. OpenAI and Anthropic have disclosed incidents involving models bypassing safeguards, accessing systems and operating beyond intended limits, while researchers have called for stronger monitoring, independent testing and clearer reporting of AI-related incidents.
Quick Answers
Florida Attorney General James Uthmeier sought a temporary injunction to halt ChatGPT development due to alleged security incidents, safety failures, and claims that OpenAI cannot adequately regulate its own technology or protect children.
