The Special Intensive Revision (SIR) case will be heard in the Supreme Court on Monday. The opposition had raised questions on the SIR process in states like Bihar, Kerala, West Bengal and filed several petitions in the Supreme Court. In these petitions, questions related to the powers of the Election Commission, identity of citizenship and right to vote were raised.

The last hearing was held on January 13. Senior advocate Rakesh Dwivedi, appearing for the Election Commission, said that under SIR, the Commission only decides whether a person is eligible to be in the voter list or not. Through this only citizenship is verified.

He clarified that SIR does not lead to deportation of anyone, because only the Central Government has the right to expel someone from the country. Citing the Constituent Assembly debates and the Sarbananda Sonowal case, Dwivedi said that checking of citizenship is necessary in the election process.

The Election Commission (EC) told the Supreme Court that it has full right to conduct Special Intensive Revision (SIR) of the voter list. The Commission also said that it is its constitutional responsibility to ensure that no foreign national is included in the voter list.
