The National Investigation Agency will send a court summons to Pakistan-based Lashkar-e-Taiba chief Hafiz Saeed, who has been named as an accused in the Pahalgam terror attack case.
The summons will be routed through the Ministry of External Affairs and will direct Saeed to appear before the NIA court in Jammu for trial.
The NIA named Saeed in a supplementary chargesheet, detailing his alleged role in the conspiracy behind the Pahalgam attack. The agency has accused him of being one of the masterminds of the attack. The NIA filed the supplementary chargesheet in July.
The special NIA court in Jammu has also issued a non-bailable warrant against Saeed.
If he fails to appear despite the legal process, the court may initiate proceedings against him in his absence under Section 356 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
The provision allows the inquiry, trial and pronouncement of judgment in the absence of a proclaimed offender who has absconded to evade trial and has no immediate prospect of arrest. The court must complete prescribed procedural requirements before beginning such a trial.
