Lok Sabha Speaker Om Birla and Rajya Sabha Chairman CP Radhakrishnan have rejected the impeachment motion to remove Chief Election Commissioner Gyanesh Kumar from the post. This proposal was signed by 193 opposition MPs (130 from Lok Sabha and 63 from Rajya Sabha) on 12 March.
After considering legal and constitutional aspects, Speakers Birla and Radhakrishnan did not approve it under Section 3 of the Judges (Inquiry) Act, 1968. With this decision, the process of removing the Chief Election Commissioner will not be able to proceed further unless a fresh initiative is taken in accordance with the constitutional provisions.

According to the rules, signatures of 100 MPs are required.
This notice was jointly signed by the MPs of all the parties of INDIA alliance. This is the first time that such a notice is being given for the removal of the Chief Election Commissioner.
For this, signatures of at least 50 MPs are required in Rajya Sabha. At the same time, for a proposal to remove CEC in the Lok Sabha, signatures of at least 100 MPs are required.

Opposition’s allegation – SIR to benefit the central government
The opposition alleges that the CEC has been helping the ruling BJP on several occasions, especially in the electoral roll review process called Special Intensive Revision (SIR). The opposition says that this process is being done to benefit the central government.
Concern has been raised about this process, especially in West Bengal. West Bengal Chief Minister Mamata Banerjee has alleged that the Election Commission is removing the names of real voters from the voter list.
Investigation committee only after the proposal is approved as per law
The Chief Election Commissioner can be removed in the same manner as a Supreme Court judge is removed. The recommendation of the Chief Election Commissioner is necessary for the removal of other Election Commissioners.
According to the Judges (Inquiry) Act 1968, if notice is given to both the Houses on the same day, the inquiry committee will be formed only if the motion is accepted by both the Houses. After this, the Lok Sabha Speaker and the Rajya Sabha Chairman will together form a joint inquiry committee.
