The Supreme Court termed cyber fraud through digital arrest as ‘digital dacoity’. CJI Surya Kant said that this is a more serious crime than ordinary extortion. Especially the elderly are being targeted through video calls. Such heartless criminals should be dealt with very strictly. The court even said that if there is scope in the law to punish before trial, it should also be used. The bench of CJI Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana was hearing the petition of Gaurav Kumar Saha and Nidhi Bhandari. Both had demanded to bring together 35 cyber crime cases registered against them in 12 states. It is alleged that his company’s bank account was used to deposit and forward the fraudulent amount. The counsel for the petitioners argued that they themselves were victims of fraud and their accounts were used without their knowledge. On this the court said, the victims cannot be called to Delhi for the convenience of the accused. It also cannot be allowed to influence the ongoing investigation in different states. Danger is higher during festivals, avoid fake message-apps. According to cyber security company Arctic Wolf, the risk of cyber fraud may increase due to increase in online shopping, digital payments and travel booking during festivals. Criminals can send fake messages in the name of huge discounts, parcel delivery, bank alerts, KYC updates and electricity bills. Personal information can be stolen from links sent through SMS, WhatsApp and email. Fake apps can also steal password-OTP. To stay safe, do not open unknown links, do not install suspicious apps and verify payment or KYC related messages only from the official website or app.
