Yami Gautam and Emraan Hashmi starrer film Haq seems to be embroiled in controversies. The film is based on the Shah Bano case, which sparked a national debate in the 1970s demanding rights for Muslim women. Now Shah Bano’s daughter has filed a petition in the Indore High Court demanding to stop the release of the film and has also sent a legal notice to the makers of the film. This case will be heard soon.

Tausif Warsi, lawyer for Shah Bano’s daughter Siddika Begum Khan, said in the petition that the film will hurt the sentiments of the Muslim community and also said that the film has presented a negative image of Sharia law.

It has also been said in the petition that the makers did not take any permission from Shah Bano’s legal heir before making the film on Shah Bano.

After the petition was filed, a legal notice has been issued to the film’s director Suparn S. Verma, production partner, promoters and the authority that certified the film.

Shah Bano’s daughter’s petition also states that the film Haq depicts the private and personal life of late Shah Bano Begum, which includes many sensitive events, personal experiences and social situations related to her family.

The lawyer said that his client Siddiqa has the moral and legal rights of her mother Shah Bano’s life protected. But the makers did not take his permission before making the film.

Let us tell you that this film is scheduled to release on 7th November. In the film, Yami Gautam plays the role of Shah Bano, while Emraan Hashmi plays the role of her husband Mohammad Ahmed Khan.

What is Shah Bano case?

Shah Bano Begum was a Muslim woman from Indore, Madhya Pradesh. She was married to a lawyer named Mohammad Ahmed Khan. Shah Bano was thrown out of the house by her husband by giving triple talaq. After the divorce, Shah Bano had filed a petition in the court for maintenance. In 1985, the Supreme Court ruled in favor of Shah Bano. Whereas according to Muslim Shariat law, a woman is given maintenance only till Iddat (mourning observed after divorce or husband’s death). The court’s decision was strongly opposed by Muslim organizations. It was said that the court’s decision is against the Sharia law of Islam.

This issue sparked a national debate, following which, under intense political pressure, the then Prime Minister Rajiv Gandhi government passed the “Muslim Women (Protection of Rights on Divorce) Act” in 1986. This law stated that a divorced Muslim woman would be entitled to maintenance only for the period of Iddat (about 3 months). However, with time, Muslim women also started being given the right to ask for maintenance. The debate is still going on in this matter.
