China’s parliament (National People’s Congress) approved changes to the national defense mobilization law on August 28. The new law will come into effect from October 1. In the new law, there is a provision not only for taking resources but also for taking them into the possession of the government. There is a provision for action and fine for refusing to obey the order or for deliberate delay. For the first time since 2010, a major change in the law was made in the National Defense Mobilization Act 2010. Now for the first time a major change has been made in it. The new law has 14 chapters and 82 articles. According to China, its purpose is that in times of danger the country can move quickly from peace to war. For this, economic and social power can also be used for defense work. The new law also includes protection of ‘development interests’ along with the country’s sovereignty, unity, territorial integrity and security. The Communist Party will decide when and how the resources will be collected. According to Samantha Hoffman, an expert of America’s Jamestown Foundation, changes have been made in the new law in areas like party leadership, organization, reserve force, recruitment, stock of essential goods and defense related education. Articles 3 and 16 of the Law place the arrangements for national defense mobilization under the Central Committee of the Communist Party. Earlier the State Council and Central Military Commission had a major role in this. According to Hoffman, if needed, the party can mobilize military, civilian, economic and social resources together and use them for its strategic goals. Hospitals, internet and transport will also have to be ready. According to the new law, sectors like transport, post, telecommunications, cyber security, medical and drug supply, food and grain supply and engineering will have to be ready for responsibilities related to national defence. The units in these areas will have to form special teams. They will also be given training, so that they can work immediately when needed. Cyber ​​security has been specifically included. The law also talks about increasing defense capability through the use of new and advanced technologies. There are also provisions for creating a reserve force, strengthening the recruitment system and increasing the stock of strategically important goods. Now development in China is also an issue of national security. In the 2010 law, there was talk of activating the defense system if there is a threat to China’s sovereignty, unity, territorial integrity and security. Now ‘development interests’ have also been included in it. That means the threat to China will not be related only to the security of the border or the country. The economy, access to essential resources, Chinese assets abroad and interests related to technological development can also be considered part of national security. According to Jamestown Foundation expert Samantha Hoffman, this change is also related to China’s national defense law amended in 2020. In that law also, a provision was made to initiate defense mobilization if the country’s development interests were threatened. The new law may also apply to people living abroad. Some laws of China may also apply to people living outside the country’s borders. This means that any work done abroad can also come under the purview of Chinese law. On July 1, 2026, China enacted the Law on Promotion of Ethnic Unity and Progress. There is a provision in its section 63 to apply the law even outside the country. An example of this came to light in 2023. Hong Kong student Yuen Ching-ting was studying in Japan at that time. When she returned to Hong Kong after posting something on social media, she was arrested. He was kept in jail for two months under the National Security Act of 2020. Is China preparing for war? After the new law, the question is arising whether China is really preparing for war. Experts have different opinions on this. Theresa Fallon, director of the Brussels-based Center for Russia Europe Asia Studies, expressed concern over the new law. He said on X that the risk of war is increasing in the world and it is difficult to ignore. He questioned whether situations like the depletion of America’s military stockpile, the Russia-Ukraine war and the Israel-US conflict involving Iran are forcing Chinese President Xi Jinping to think that the time of war is approaching. At the same time, Lyle Morris of Asia Society Policy Institute says that this law should not be considered as a sudden war preparation by China. According to him, China has been making such preparations for more than 10 years. However, the new law definitely shows that China is not just preparing its army for any major crisis. It has also made common people, companies, essential services, technology and data a part of this preparation.
