The Trump administration of America is preparing new immigration rules, which may make the process of H-1B visa, employment-based green card and student visa more strict than before.

The proposed changes, if implemented, could make it more difficult and costly for Indian professionals, students and US companies to comply with the rules. These proposals are included in the integrated regulatory agenda of the US Department of Homeland Security, Department of Labor and State Department. For this, a proposal for change may come in August.

H-1B: The H-1B cap exemption available to universities and some research institutions may be limited. There are many such proposals which may increase the costs of companies.

green card: There is a proposal to increase the minimum wage applicable for H-1B and Green Card. Also, changes are proposed in recruitment rules, provisions related to layoff of American employees and anti-discrimination measures.

Student Visa: Under the proposal, the existing ‘duration of status’ system can be abolished for foreign students and a fixed period of stay can be fixed.

External Affairs Minister S Jaishankar had raised this matter with US Secretary of State Marco Rubio in May this year. Rubio acknowledged that there may be some problems and tensions during the transition to the new immigration system.

However, Rubio said that America is trying to make the immigration system more effective and in the long run it will benefit all parties. Rubio had also said that this step was not taken specifically targeting India.

According to him, America has been struggling with the problem of illegal immigrants on a large scale in the last few years. More than 20 million people entered America illegally and these changes are being made to deal with that challenge.
