Kerala High Court, considering the viral girl prima facie an adult, has given one month transit bail to her husband. Now Madhya Pradesh Police will not be able to arrest her husband for a month. He can file a petition in the Madhya Pradesh court for anticipatory bail. High Court Judge Kausar Edappagath said – The girl’s date of birth is recorded as January 1, 2008 in her birth certificate, hence she is an adult. On this, Additional Solicitor General SV Raju, appearing for Madhya Pradesh Police, claimed that this certificate is fake. Actually the viral girl is a minor. The judge did not accept this argument and said – apart from the birth certificate, the voter ID and bank passbook of applicant number 2 (viral girl) have also been presented in the court. From which it becomes clear that he is an adult. She herself is claiming to be an adult. The viral girl has also given an affidavit that she is married to applicant no. 1. The court, while disposing of the bail plea of the viral girl’s husband, said that he can seek anticipatory bail in the competent court of Madhya Pradesh within a month from June 3. He will not be arrested until this period expires. Argument – Hindu girl and Muslim boy, marriage in temple is not justified. The viral girl and her husband had claimed in their joint petition that if they go to Madhya Pradesh, they can be subjected to honor killing by fundamentalist elements because they belong to different religions. He had also said that without a protection from arrest order he could neither travel nor approach a lawyer to file a bail plea in Madhya Pradesh. At the same time, Additional Solicitor General SV Raju told the court – the girl is a Hindu and her husband is a Muslim, hence their marriage in the temple is not valid. On this basis the local marriage registrar does not have the authority to issue them a marriage certificate. Both of them met during the film shooting. Actually, the viral girl met the young man during the film shooting in Kerala. Gradually, the closeness between the two increased and they got married in March 2026. The matter came into controversy when the National Commission for Scheduled Tribes raised objection to the marriage. The Commission claimed that the viral girl was 16 years old at the time of marriage and fake documents were used for the marriage. After this, Khargone police registered a case against the viral girl’s husband under the POCSO Act. FIR was lodged against the director in Kerala. Viral Girl had lodged an FIR against director Sanoj Mishra and three others under POCSO Act on 29 April 2026. After the FIR, Ernakulam Central Police of Kerala has registered a case and started investigation. The victim had alleged that when she was a minor, director Sanoj Mishra had abused her during the shooting of the film ‘The Diary of Manipur’. Mishra exploited her by promising her acting opportunities. Kerala VHP leader and lawyer Anil Vilayil is also among the accused. The victim has accused him of defaming her on social media. The names of two other accused have not been revealed yet. Film director said – the allegations are a well-planned conspiracy. On the other hand, film director Sanoj Mishra has called these allegations a well-thought-out conspiracy. Claimed that he was being targeted for raising his voice on issues like ‘Love Jihad’. Mishra alleged that the actress of his film was lured to Kerala. The minor girl was married on the basis of fake documents. Now, for raising his voice in the matter, he himself is being implicated in a false case. Two different certificates of date of birth were found. The viral girl’s marriage has been in controversy since the beginning. First it was described as ‘Love Jihad’, then the family claimed that she was a minor. During investigation, discrepancies were found in the birth certificate of Maheshwar Municipal Council. As per medical records he was born on 30 December 2009. At the time of marriage on 11 March 2026, her age was 16 years, 2 months and 12 days. After this, the administration had given instructions to cancel the old certificate dated January 1, 2008. The family had said – The viral girl’s parents complained that the young man had persuaded her to marry by coaxing her. The investigation by the National Commission for Scheduled Tribes (NCST) revealed that she was a minor at the time of marriage. After this, a case was registered against the husband under POCSO Act. He had to appear before the police for statement in this case. The viral girl had accused her parents of torture. The viral girl had given a statement at the Thampanoor police station in Kerala, accusing her parents of torture. She had said that her family members were pressurizing her to marry her uncle’s son, even though she considered him her brother. The young man supported her during her mental stress. When their closeness turned into love, both of them got married in a temple in Kerala in the presence of local people.
