The Karnataka government has withdrawn the 2022 decision to ban hijab in schools and colleges. Under the new order, apart from hijab, students have also been allowed to wear Kalava, Rudraksha and Janeu. Provided that these are within the discipline and rules of the school.

The then BJP government of Karnataka had issued an order in February 2022. Under which it was made mandatory for students in government pre-university colleges to follow the prescribed uniform.

The order said that it would not be allowed to wear such clothes which affect ‘equality, unity and public order’. After this order, entry into classes wearing hijab was banned in many government educational institutions.

Now know the hijab controversy in Karnataka…

Controversy over hijab started in December 2021

On December 31, 2021, 6 Muslim girl students were stopped from wearing hijab in a college in Udupi district of Karnataka, after which they sat on a strike. The controversy spread to the rest of the state as well. After this, students associated with Hindu organizations in turn started coming to college wearing saffron shawls.

When violence occurred, in February 2022, the state government banned the wearing of all types of religious-identified clothing in schools and colleges. The order said that any clothing which would disturb equality, integrity and public law and order would not be allowed to be worn. There was a lot of uproar regarding this order.

The case reached the High Court in March 2022, the order remained intact

In March 2022, the Karnataka High Court upheld the government’s order and said that hijab did not prove to be a ‘compulsory religious practice’ in Islam. Then the matter reached the Supreme Court.

In October 2022, a two-judge bench of the Supreme Court gave a divided decision. One judge talked about lifting the ban, the other upheld the High Court’s decision.

Why did it take 4 years for the Karnataka government to change its decision?

In October 2022, a two-judge bench of the Supreme Court gave a divided verdict. Justice Hemant Gupta accepted the Karnataka High Court’s decision and the ban as correct. Justice Sudhanshu Dhulia said that education and choice of girl students is more important and the ban is wrong.

Due to difference of opinion between the two judges, the case was referred to a larger bench. After this, regular hearing did not start in the larger bench for many years and the final constitutional decision remained pending.

Meanwhile, the legal position remained that the 2022 decision of the Karnataka High Court continued to be effective, because the Supreme Court had not completely repealed it. After a wait of four years, no final decision came from the court. Then the Congress government in Karnataka withdrew the old ban order at the administrative level.
