However, this ban will not apply to Hijab i.e. the scarf that covers the head and hair. If the student wearing a face covering is a minor, his or her parents may be fined. It is necessary to get the new rules passed by the Parliament within 60 days. The new rules will currently be implemented as decree-law i.e. temporary law. To make them a permanent law, the approval of the Parliament will have to be taken within 60 days. The government says the purpose of these rules is to help foreign students integrate better into the Italian school system and learn the Italian language. No 30% limit on every foreign student The government has made it clear that the 30% limit will not apply to every non-Italian student. This is for some foreign students who do not have sufficient experience with the Italian language or school system. This count will include children in primary school who were not born in Italy or who have not attended at least 2 years of pre-school in the Italian education system. Secondary schools will count as non-Italian students who have not completed at least 3 years of study in the Italian national education system. Children born in Italy and who have been studying in the school system there for a sufficient period of time will not be counted towards the 30% limit. That is, on the issue on which the Meloni government is now going to bring a law, a party which had a tougher stance than them was already putting pressure on it. There has been a ban on covering the face in Italy for 50 years. There is a law regarding covering the face in Italy since 1975. Under this, it is prohibited to cover the face in public places in such a way that a person cannot be identified. However, exemptions may be given in certain circumstances. In a 2008 court decision, it was said that if a person covers his face for religious or cultural reasons, he will not be considered breaking the law just because of this. The circumstances of the case will also be looked into. Now the Meloni government is preparing to ban burqa and niqab separately in schools. After the approval of the government, the proposal will be sent to the Parliament to make law. It will be necessary to get approval from the Parliament within 60 days. The European Court has justified the ban on burqa. The European Court of Human Rights has justified the ban on burqa-niqab in public places in France and Belgium. In a 2014 decision in France and a 2017 decision in Belgium, the court had said that maintaining harmony between people could be the basis for such a ban.
