Delhi High Court on Monday rejected the petition of Vimal Cardamom Company. In this petition, a demand was made to cancel the notices received by the company’s brand ambassadors Shahrukh Khan, Ajay Devgan and Tiger Shroff. Justice Swarn Kanta Sharma said that Delhi High Court does not have territorial jurisdiction in this matter. Maharashtra courts are a more appropriate and convenient forum for complaints related to notices. In fact, Maharashtra Food and Drug Administration (FDA) had sent show cause notices to the three artistes on August 14 alleging misrepresentation of the product in the advertisements of Vimal Cardamom. Answer: Maharashtra Food and Drug Administration (FDA) alleges that the advertisements of Vimal Cardamom may be surrogate advertisements of the banned Vimal Pan Masala. Surrogate advertising means promoting a banned product under the name of another similar product instead of directly advertising it. Vimal cardamom manufacturing company PB Agro LLP filed a petition in the Delhi High Court. The company had sought cancellation of the show cause notice sent by Maharashtra FDA to Shahrukh Khan, Ajay Devgan and Tiger Shroff. Question: What did Maharashtra Food Department ask for from the actors in response? Answer: FDA sought documents from the actors involved in the advertisements to prove that Vimal Cardamom and the banned Pan Masala are different products. The advertisement is not an indirect promotion of any banned product. The FDA also asked to stop advertising and remove related promotional materials from digital platforms. Question: What argument did the company give in the court on behalf of the actors? Answer: The company said that the FDA’s August 11 notice was sent only to the actors, not to the company. Any action will cause the biggest loss to the company. The company was not given a chance to present its side. Maharashtra FDA does not have the authority to direct to stop advertising. Vimal Pan Masala has not been produced or sold in Maharashtra since 2001. The Supreme Court has banned pan masala containing tobacco across the country since 2013. Question: What did the Delhi High Court say during the hearing, why was the petition rejected? Answer: Justice Swarn Kanta Sharma said that this case cannot be heard in Delhi High Court, because the dispute is mainly related to Maharashtra. The court said- The notice has been issued by Maharashtra FDA based in Mumbai. The notice pertains to alleged activities and legal violations that took place in Maharashtra. The respective brand ambassadors are residents of Mumbai. Therefore, Maharashtra courts can hear this case. Question: What rights do you get by having a company office in Delhi? Answer: The court said that merely doing business of the company in Delhi, making payment from Delhi or planning the ad in Delhi does not automatically give the Delhi High Court the right to hear. However, the actors say that there should be a ban on sales and not on advertising. Shahrukh Khan and Ajay Devgan have already said that if a product is harmful for health, then the government should ban its manufacture and sale. In an old interview given to CNN-IBN, Shahrukh Khan was asked that the Health Minister has appealed to the celebrities not to advertise products like soft drinks, because children start drinking them after seeing them. On this, Shahrukh had said that if cigarettes or soft drinks are bad, then the government should stop their sale and production in the country. The government gets revenue, then why stop my earnings – Shahrukh Shahrukh Khan had argued in his reply that the government does not stop such products because they are a source of revenue for the government. Shahrukh had said that when the government is not stopping production for its revenue, then his earnings should also not be stopped. He said that he is an actor and earning money by working is his profession. If something is really wrong, then its making should stop. Ajay Devgan said – I only promote cardamom. Even in the year 2022, when the controversy over such advertisements had increased, actor Ajay Devgan had presented his side. Ajay had said that he only advertises ‘Elaichi’ and denied the allegations of surrogate advertising. He had said that using a product depends on the personal preference of the person. Ajay also agreed with Shahrukh Khan and said that if a product is harmful, then first of all its manufacturing should be banned.
