The bench of Justice Dipankar Dutta and Justice AG Christ dismissed Jacqueline’s petition, saying that if needed, she could later come back to court at the right time.

On behalf of Jacqueline, senior advocate Mukul Rohatgi argued that the case of the prosecution is that she should have taken more care while taking gifts from Chandrashekhar. Justice Dutta said that nothing has been proved yet, but these allegations cannot be dismissed before the trial. The allegations will be considered the same.

He said, if a friend gives something to the other and later it is revealed that the giver is involved in a crime, then the matter becomes difficult. He also said that this case is not about getting gifts that have been found inadvertently.

Jacqueline Fernandes moved the Supreme Court when the Delhi High Court dismissed her similar petition on 3 July. The High Court had said that whether they have committed a crime or not, it can be decided only during the trial.
