Imran Khan holds American citizenship and lives in India through Overseas Citizen of India Card.
Actor Imran Khan challenged the notice to leave India in the Bombay High Court on Saturday. He has called it arbitrary, illegal and unconstitutional.
Mumbai’s Foreigners Regional Registration Office (FRRO) also sent him a second notice on Saturday. It has been asked why his Overseas Citizen of India (OCI) card should not be cancelled. Imran has been given 15 days to reply. In the first notice, he was asked to leave India before October 28.
According to news agency PTI, Imran filed the petition through his lawyer Zulfiqar Memon and MZM Legal.
The petition said that there is no provision in the existing law or rules which prevents an OCI cardholder from participating in a peaceful protest.

Imran was detained from August Kranti Maidan in Mumbai on 8 October.
On behalf of Imran, it was said that the police did not give any reason while issuing the notice nor did they provide documents in support of it. He did not even get a chance to present his side. In the petition, his being taken into police custody on October 10 has also been termed as wrong.
Imran said that the notice violated Articles 14 and 21 of the Constitution. He alleged that the action against him followed a complaint lodged by a political party leader.
The petition raised questions as to why due legal process and principles of natural justice were not followed. Imran also wanted to know the basis for issuing the notice.
In this case, an early hearing can be demanded before the bench of Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna.

Imran had reached the protest on October 10
Imran Khan took part in the protest in Mumbai on October 10 demanding the resignation of Chief Election Commissioner Gyanesh Kumar. The police had stopped him at the barricade before August Kranti Maidan.
After this he was taken into custody. Imran said that he later came to know from the media that his name was registered in the FIR in the case.
His legal team has demanded the police to provide CCTV footage of the area, so that it can be clear whether he was involved in the protest or not.
His lawyer told that Imran was passing through Nana Chowk that day. He gave the statement when the road was closed and media persons asked questions.
Before being taken into custody, Imran had said that as a city resident, he had come there to see the restrictions and the suppressed voice of the people.

Imran had also shared the picture of the custody from the police van.
The whole controversy started with Kirit Somaiya’s complaint
This whole matter started after the complaint of former BJP MP Kirit Somaiya. Somaiya had written a letter to Mumbai Police and FRRO alleging that Imran Khan, being an American citizen, participating in the political protest is a direct violation of OCI rules and visa conditions.

Kirit Somaiya is the vice president of Maharashtra BJP. He has been a Member of Parliament (MP) of the 13th and 16th Lok Sabha from Mumbai North-East Lok Sabha constituency.
According to the Citizenship Act, Overseas Citizen of India (OCI) cardholders get the facility to reside and move in India, but they are not allowed to have any political rights or participate in the movement in India. This entire legal action has started due to CJP’s participation in the protest against Chief Election Commissioner Gyanesh Kumar.
Impact on the release of Imran’s comeback film
According to the report of Mid-Day, the release and promotion of Imran Khan’s comeback film ‘Adhure Hum Adhure Tum’ may be affected. The film was planned to be released on Netflix in December. Imran was going to start its promotion after Diwali, but due to the current situation, questions have been raised on the plan.
According to the report, the film team does not want to start promotions until the situation becomes clear. However, the official release date of the film has not been revealed yet.
Imran was last seen in the 2015 film ‘Katti Batti’. After almost 11 years, he is going to make a comeback with Bhumi Pednekar in the film ‘Adhure Hum Adhure Tum’.
