Rahul Gandhi had denied taking an “oath” for his allegations against the Election Commission, stating that he has already taken an oath on the Constitution.

Chief Election Commissioner Gyanesh Kumar on Sunday countered Rahul Gandhi’s “Constitution oath” argument over his allegations of vote theft on the poll body, and said that it is mandatory for the individual to take an oath “as a witness” if he is not a voter of the constituency the complaint is being made for.

“If you are not an voter of that constituency, then you have only one option in the law and that is The Registration Of Electors Rules, rule number 20, sub-clause (3), sub-clause (b) which says that if you are not an voter of that constituency, then you can lodge your complaint as a witness and you will have to give an oath to the electoral registration officer and that oath will have to be administered in front of the person against whom you have complained,” CEC said while answering a question by News18 India at a press conference in the national capital.

This comes days after Rahul Gandhi slammed the poll body for demanding an affidavit under oath from him to support his vote theft claims.

“The ECI asks me to file an affidavit and give information under oath. I have taken an oath inside the Parliament holding the Constitution,” Rahul Gandhi said earlier.

He alleged that the Election Commission colluded with the BJP to “steal” the Lok Sabha election from the people.

Politics heated up after the Election Commission started special intensive revision of electoral rolls in Bihar ahead of the Assembly polls, with the Opposition alleging that the poll body was leaving the names of people out of the voter list for the benefit of the BJP.

Earlier today, Rahul Gandhi alleged that attempts were being made in Bihar to manipulate the Assembly polls through voter additions and deletions under the SIR of the electoral rolls.

“In the whole country, Assembly and Lok Sabha elections are being stolen, and their last conspiracy is to delete and add voters through SIR to steal the elections in Bihar,” he said at the launch of his 1,300-km Voter Adhikar Yatra from Sasaram.

“We will not let them steal the election in Bihar. People of Bihar will not let them steal elections. The poor only have the power of the vote and will not let them steal polls,” he added.
