‘Is It Not The Time?’: Delhi HC Says Uniform Civil Code Implementation Would End Conflicts

Delhi High Court suggests moving towards Uniform Civil Code, stating UCC would create a single framework and end conflicts between personal laws and national legislation.

The Delhi High Court on Friday asked if this is not the time to move towards the Uniform Civil Code and said the UCC will ensure a single framework where personal or customary law does not override national legislation.

The High Court said that the implementation of the UCC would end the conflict. No doubt UCC’s opponents caution the risk of eroding religious freedom, such freedom cannot extend to practices that expose individuals to criminal liability, it said.

The bench made these observations while deciding a bail plea filed by Hamid Raza, charged under IPC Section 376 (rape) and POCSO Act, for marrying a minor girl who was allegedly sexually assaulted by her stepfather and bore a child from that abuse
