Imran Khan’s lawyer has given Adiala Jail authorities 24 hours to facilitate the signing of a Power of Attorney by the former Pakistan prime minister, alleging that the document has not yet been presented to him despite repeated requests.
In a letter dated August 22 and addressed to the Senior Superintendent of Central Jail Adiala, Rawalpindi, lawyer Khalid Yousaf Chaudhry said the delay was preventing the execution of the Power of Attorney required to file a contempt petition before the Supreme Court of Pakistan.
Chaudhry, who described himself as Khan’s authorised legal counsel, said he had been entrusted with managing and pursuing multiple legal proceedings on behalf of the jailed Pakistan Tehreek-e-Insaf leader.
The lawyer said a contempt petition on Khan’s behalf was required to be filed before the Supreme Court in accordance with an order passed by the top court on August 18. He said Supreme Court lawyer Uzair Karamat Bhindari had been engaged to represent Khan in the matter and was also representing him in the main case.
Lawyer Says Power Of Attorney Was Not Presented To Imran Khan
According to the letter, Chaudhry personally visited Central Jail Adiala on August 20 carrying three Power of Attorney documents required for the Supreme Court proceedings.
He said that when he reached Gate No. 5 of the jail, where matters concerning Khan are handled, his name was recorded by jail staff and he was asked to wait for permission.
“Despite repeated follow-ups,” Chaudhry alleged, the Power of Attorney was neither forwarded to Khan nor received back by him for execution.
The lawyer said the failure to facilitate the signing was obstructing Khan’s ability to approach the Supreme Court.
He alleged that the jail authorities’ inaction and failure to perform their statutory duties amounted to “gross misconduct, dereliction of duty, and abuse of authority”.
Adiala Jail Given 24 Hours
Chaudhry has now called upon the jail authorities to ensure that the Power of Attorney is presented before Khan for his signatures and thumb impression within 24 hours.
He has also demanded that the duly executed documents be returned to him within another 24-hour period so that the contempt petition can be filed before the Supreme Court.
The letter was also marked to the Inspector General of Prisons, Punjab, Lahore, the Superintendent of Police, Saddar Division, Rawalpindi, PTI’s head of legal affairs and Khan’s Supreme Court counsel.
Affidavit Also Submitted Before Supreme Court
The lawyer’s letter further states that an affidavit concerning the alleged failure to facilitate execution of the Power of Attorney has already been submitted before the Supreme Court in a contempt petition filed by Dr Uzma Khan.
Chaudhry enclosed copies of the relevant legal documents with his communication to the jail authorities.
The letter concerns Khan’s ability to formally authorise his lawyers to pursue the proposed proceedings before the Supreme Court. It does not itself establish that the jail authorities deliberately prevented Khan from signing the documents; the allegations were made by his counsel in the letter.
Khan remains confined at Central Jail Adiala, Rawalpindi, in connection with the cases mentioned in the lawyer’s communication.
