Meta’s copyright system is being misused to target creators creating original content on Instagram. Unknown people are using Facebook’s edit feature to backdate posts and then sending fake copyright strikes on content from original creators. Two big digital creators Pushkar Raj Thakur and Neeraj Joshi have filed a commercial suit against this game in Delhi High Court. What allegations did the creators make in the court? Financial educator Pushkar Raj Thakur and digital creator Neeraj Joshi have made serious allegations in separate petitions. He says that some unknown people are using fake copyright strikes as a weapon to harass the original creators and threaten to close their accounts. Due to this system, there is a danger of their original content being deleted or their Instagram account being suspended/deleted. Questions raised on Meta’s automated system Creators argue that Meta’s automated copyright system is working without any thorough investigation. The system takes action on strike complaints without checking the video’s original creator, metadata, edit history, or actual publishing chronology (exact time of upload). Pushkar Raj Thakur told that due to this fake game dozens of his videos were removed, disabled or restricted. Surprisingly, Meta denied Thakur access to its ‘Rights Manager’ tool, even though fraudsters continued to send fake strikes against him using the same tool. Court order in Neeraj Joshi’s case: Hearing in the case of digital creator Neeraj Joshi was held in the court of Justice Jyoti Singh on July 9. The court recorded Meta’s statement in which the company said that if Joshi’s account is not yet permanently closed, they will investigate the allegations and keep his verified Instagram account (@Neerajjoshi5014) safe. Along with this, the court has directed Meta to provide the related Basic Subscriber Information (BSI) and IP logs to Neeraj Joshi within three weeks. This information can help in identifying unknown people who are tampering with their account. Summons have been issued in the case and the next hearing on Joshi’s interim stay application will be held on August 5. What happened in Pushkar Raj Thakur’s case? Justice Tushar Rao Gedela, while hearing Pushkar Raj Thakur’s plea on May 29, had asked Meta what steps it had taken or what measures it could take to prevent such misuse of its platform. After this, on July 1, the matter came before Justice Anup Jairam Bhambhani. During the hearing, Meta assured the court that Thakur’s video would not be removed on the grounds of copyright strike till the next hearing. Also, their account will not be closed due to recurring copyright strikes. Meta also agreed that as soon as Thakur handed over the URLs of the removed videos, they would restore those videos. Recording these assurances, the court has fixed the next hearing of the case on July 17. Creators seek compensation of ₹2 crore from Meta Pushkar Raj Thakur has demanded from the court that Meta be stopped from removing his original content on the basis of such fake and backdated claims. They have also sought directions to the company to implement KYC security measures, timestamp protection, metadata verification and anti-manipulation protocols within the Rights Manager tool. Additionally, Thakur has sought damages of approximately ₹2 crore from Meta and the unknown fraudsters for loss of followers, loss of monetization opportunities, loss of sponsorships and damage to his commercial reputation. Such cases have raised concerns among digital creators, as copyright tools meant to protect original content are now being used to target the creators themselves.
