A US judge on Friday directed the Justice Department to provide reasons justifying its decision to withdraw criminal cases against Indian businessman Gautam Adani. The court has refused to immediately rule on a request by Adani’s lawyers to formally dismiss the case.
Federal prosecutors had announced on May 18 that they would not prosecute the case further. In the case, Adani was accused of securities fraud and wire fraud related to the bribery scheme.
After this, Adani’s lawyers on Wednesday requested US District Judge Nicholas Garaufis of Brooklyn to formally dismiss the case. However, the judge said that the prosecutors’ notice does not provide a complete explanation of the decision.
Garaufis said that the government’s brief, flat and concluding statement is not a sufficient basis for the court to reach any conclusion. Besides this, it is also not suitable for analyzing the government’s request for dismissal of the case.
The decision changed between the tenures of two presidents
This case against Adani was registered in 2024 at the end of the term of Democratic President Joe Biden. The decision to drop the charges comes during Republican President Donald Trump’s second term in the White House, where the Justice Department has sought to end another high-profile white collar criminal case.
Legal experts say American judges have little authority to force prosecutors to pursue cases they do not want to pursue. However, unless Garaufis refutes it, charges will remain officially pending. The spokesperson for the Brooklyn US Attorney’s Office has refused to give any statement on this.
What is the whole matter and what agreements were reached?
Gautam Adani was accused in 2024 of agreeing to bribe Indian government officials so that a subsidiary of the Adani Group could get approval to develop a solar energy plant.
After this, he was accused of misleading American investors by giving reassuring information about his company’s anti-corruption practices. However, Adani Group has always denied these wrongdoings and Adani himself has never appeared in a US court in this case.

Settlement with SEC: The US Securities and Exchange Commission (SEC) also imposed civil charges. Under this, an agreement has been reached, in which Gautam Adani will pay $6 million and his nephew Sagar Adani will pay $12 million.
Penalties for violation of restrictions: Adani Enterprises Ltd. has separately agreed to pay $275 million to the US Treasury Department to resolve alleged violations of US sanctions on Iran.
Case beyond the scope of US law: Adani’s lawyer
Adani’s lawyer Robert Giuffra argued in a letter to Judge Garaufis on June 24 that the case fell outside the scope of US law and that prosecutors would be unable to prove the alleged bribery took place in India.
Lawyers for Adani and his co-accused held several meetings with Justice Department officials and submitted nearly 500 pages of documents to explain the shortcomings of the case, the lawyer said.
According to Giuffra, the US Justice Department’s decision reflects careful consideration of the legal and factual weaknesses of the case.
Disagreements between officers and career prosecutors
In a letter sent to the judge last month, senior officials said the Justice Department had decided not to devote further resources to these criminal charges against individual defendants. The special thing is that the rank-and-file (career) prosecutors who brought this case did not sign this letter.
Earlier last year, Justice Department officials in Washington had dropped corruption charges against the then New York Mayor Eric Adams during Biden’s tenure, despite strong opposition from career prosecutors, after which many career prosecutors resigned. At present, the judge has set a deadline of July 13 to provide more information in this case.
