Following Swati Maliwal’s complaint, Delhi Police arrested Bibhav Kumar from the CM House on May 18.
The hearing of the Swati Maliwal case will be held in Delhi’s Tis Hazari Court on Tuesday (30 July). Delhi CM Arvind Kejriwal’s former PA Bibhav Kumar is accused of misbehaving with Swati. The incident took place on May 13. Delhi Police arrested Bibhav on May 18. He has been in jail since then.
On July 7, a Delhi court extended Bibhav Kumar’s judicial custody till July 16. After this, Delhi Police filed a 500-page charge sheet against Bibhav Kumar on July 16. He was produced in Tis Hazari Court through video conferencing. The court directed the police to produce Bibhav Kumar on July 30.
Earlier, on July 12, his bail plea was heard in the Delhi High Court, but the court refused to grant him bail. Justice Anoop Kumar Mendiratta had said that there is no ground to grant him bail.
Based on Maliwal’s complaint, an FIR was registered against Bibhav Kumar under sections 308 (attempt to commit culpable homicide not amounting to murder), 354B (assault or criminal force to woman with intent to disrobe), 341 (punishment for wrongful restraint), 506 (punishment for criminal intimidation) and 509 (word, gesture or act intended to insult the modesty of a woman) of the Indian Penal Code.

The High Court had said that Bibhav’s petition was fit for hearing
Bibhav Kumar had moved the High Court after his bail plea was rejected twice by the trial court. On July 1, the High Court accepted Bibhav Kumar’s petition challenging the arrest. Justice Swarn Kant Sharma, calling the petition admissible for hearing, had issued a notice to the Delhi Police and sought a reply.

Swati cried during the hearing in the trial court
Bibhav Kumar had filed a bail plea in the trial court on May 25, which was heard on May 27. Swati was also present in the court during the hearing. Bibhav’s lawyer Hariharan alleged during the hearing that when there were no injury marks on sensitive body parts, there is no question of attempted culpable homicide. Neither did Bibhav have any intention to undress Swati. These injuries could be self-inflicted.

Bibhav was dismissed for assaulting a government employee
In March 2024, Bibhav was dismissed from the post of CM’s personal secretary. Special Secretary Vigilance YVVJ Rajasekhar issued an order saying that Bibhav’s services have been terminated with immediate effect. The prescribed procedure and rules were not followed for his appointment. Therefore, this appointment is declared illegal and void. Rajasekhar gave this order on the basis of a 2007 case.
In fact, in 2007, Bibhav was accused of allegedly assaulting a government official. Mahesh Pal, posted in Noida Development Authority, had accused Bibhav that along with his three colleagues, he prevented the complainant (a public servant) from performing his duty, abused and threatened him. Mahesh had lodged a complaint in Noida Sector-20 police station on 25 January 2007. Action was also taken by the Lieutenant Governor of Delhi in this case.
