US death-row inmate Christa Pike regained consciousness at a Tennessee hospital on Tuesday, days after surviving a botched lethal injection, according to her lawyer.
Pike’s first words after waking were “Where am I?” and “Who are you?”, her lawyer said on Wednesday. Her legal team had believed for several days that she was brain dead and expected doctors to withdraw life support.
Her waking up was described by her lawyer as a “shock to everyone”.
Pike is believed to be the only person to have survived an execution attempt by lethal injection. She has only limited memories of the September 30 execution attempt, during which she was administered two rounds of the drug pentobarbital.
“We don’t know the toll all of this will take on her mental health, lawyer Luke Spivey said, describing Pike as “angry and confused” following the ordeal, CNN reported.
Legal Team Seeks To Preserve Details Of Failed Execution
A Tennessee judge on Wednesday directed the state to preserve all evidence related to Pike’s failed execution after her lawyers requested an emergency order.
The order covers materials from the execution room, including IV lines and syringes, along with packaging, inserts and labels. It also requires the preservation of records relating to Pike’s psychological condition before, during and after the execution.
Pike’s lawyer Luke Ihnen told the court that communicating with his client had been challenging because she remained unconscious until Tuesday and was now only “speaking limitedly”.
Her legal team said the preserved evidence could potentially serve as the basis for a future lawsuit against the state.
Failed Execution Raises Questions Over Next Steps
Tennessee could seek to execute Pike again, although another lethal injection attempt is likely to face significant legal challenges, according to Tennessee-based defence attorney Stephen Ross Johnson, as reported by the BBC.
“For the state to attempt to execute her again using the same methodology, they would have severe legal hurdles,” Johnson said.
According to Johnson, Pike’s medical condition and the failed execution could make it difficult for the state to justify another attempt using lethal injection.
Tennessee could also pursue a different execution method, but that would bring additional legal hurdles and could require approval from the governor’s office and state legislature.
