The Supreme Court on Thursday refused to hear a petition challenging the decision of a 15-year-old rape victim to terminate her 30-week pregnancy. The court said that a minor cannot be forced to become a mother and the decision in such cases should be that of the victim. The bench headed by Chief Justice Surya Kant asked the Center to change the law related to time limit for abortion in such cases. The court said- The law should be such that it keeps changing with time and according to the current situation. AIIMS had said that at 30 weeks of pregnancy the fetus is a ‘viable life’ and abortion cannot be successful at this stage. After listening to the arguments of the AIIMS doctors, it was said that after talking to the victim’s parents, it should be decided whether to continue the pregnancy or not.
