Opposition MPs have given notice in Parliament for the removal of Chief Election Commissioner Gyanesh Kumar. In the notice brought in Lok Sabha-Rajya Sabha, 7 allegations have been made against CEC. It has been said that they work at the behest of the government.

The opposition alleges that Gyanesh Kumar took away the voting rights of the people through SIR. Questions have also been raised on his appointment in the notice.

The notice submitted to both Houses of Parliament on March 12 demanded the CEC’s removal on the grounds of proven misconduct.

130 opposition MPs in the Lok Sabha and 63 in the Rajya Sabha have also demanded to bring a resolution to remove the CEC.

7 allegations of opposition against CEC

The opposition’s allegations include the process of Kumar’s appointment as CEC, his biased press conference on August 17, 2025 targeting Rahul Gandhi, discriminatory treatment of opposition and ruling party members, obstructing the investigation, refusing to provide means of transparency and implementing the ‘Special Intensive Review’ (SIR) process to suit the political objectives of the ruling party.

It is being claimed that the opposition may bring an impeachment motion against the CEC during the Manasutra session. To bring an impeachment motion, it is necessary to give notice 14 days in advance.

  • Questions on the impartiality of the Election Commission: The opposition CEC has transformed the ECI from an impartial electoral body into an ‘instrument’ implementing the political agenda of the executive. They have transformed it from an institution that conducts fair elections into a tribunal that decides citizenship.
  • SIR conditions imposed before Bihar elections: The SIR process, conducted just 5 months before the Bihar Assembly elections, had imposed document-related conditions that resulted in the most vulnerable sections of society being denied the right to vote. 65 lakh voters were affected by this.
  • Biased mindset and working style: CEC did the SIR process at rocket speed in big states where elections were to be held in 2-3 months. Kept a stubborn attitude towards reconsidering the deadline. Be completely insensitive towards the problems of the people. Every request of the opposition was deliberately ignored.
  • Bihar model brought to Bengal: The Bihar model was replicated in other states also. The draft electoral rolls released in Bengal revealed that about 58 lakh names out of 7.66 crore voters were removed. More than 60 lakh voters are still under investigation, creating uncertainty over their right to vote even just weeks before the assembly elections.
  • Selection Process of CEC: The matter of CEC selection process is currently pending in the Supreme Court as a constitutional challenge. The notice also mentions the dissent lodged by Rahul Gandhi in February 2025. It is said that the hasty manner in which this appointment was made at midnight clearly shows that the government deliberately wanted to appoint a person of its choice to the post.
  • Intentional obstruction of justice: CEC has been accused of allegations of fraud in voter list in Aland, Karnataka, refusal to provide machine-readable voter list, refusal to release CCTV footage from polling stations. The EC has become an opaque and accountability evasive institution.
