The Supreme Court said that the use of fake legal precedents created with Artificial Intelligence (AI) is dangerous. To explain its seriousness, the court said that this danger is as big as the leakage of poisonous (AI) gas in the Bhopal gas tragedy. The bench of Justice PS Narasimha and Justice Alok Aradhe made this comment while setting aside the NCLT decision. He said- Presenting false and non-existent decisions made by AI in the court as genuine harms the justice system. Therefore, the courts should not show any leniency in such cases. The court said that fake legal information may seem like a small thing, but it is very dangerous. This spoils the judicial process and can also reduce people’s confidence in the court’s decisions. Understand the whole matter… This case is about the bankruptcy dispute related to Essel Infraproject Limited, Jammu and Kashmir Bank Limited and Pooja Ramesh Singh. In this case, NCLT Mumbai had accepted a petition under Section 7 of IBC, which was later challenged in the Supreme Court. Many of the legal cases that NCLT cited to justify its decision did not actually exist. The names of some such cases were mentioned in the judgment, which were completely fabricated i.e. fake. Their legal citations were also made and no actual record of them existed. Jammu and Kashmir Bank Limited gave an affidavit in the Supreme Court saying that its lawyer had not cited these fake cases.
