- Supreme Court Concerned Over Pending Bail Petitions | Auto Listing System Demand

The Supreme Court on Monday expressed concern over the increasing number of bail petitions in different High Courts of the country. The court said that it is necessary to create a strong system for quick hearing and decision of bail cases.
The bench of Chief Justice Surya Kant and Justice Joymalya Bagchi said that for this, a system of automatic listing of pending bail petitions should be prepared and there should also be a fixed time limit for disposal of the cases.
The court said that the High Court, state governments and investigating agencies should together prepare such a system so that bail cases can be decided on time. Its purpose is not to raise questions on the functioning of any High Court, but to make the system better.
The Court reminded that Article 21 of the Constitution guarantees the protection of life and personal liberty of every person. The rights of the victims should be taken full care of in this process.
Supreme Court had sought information about pending bail petitions
In fact, the Supreme Court had sought information about pending regular and anticipatory bail petitions from the Registrar General of all the High Courts. The court had asked when the petition was filed, when it was heard and what is the status of the decision.
The court said that most of the High Courts have given the necessary data. Efforts have also been started at many places to dispose of pending cases expeditiously.
The Supreme Court described the number of pending bail petitions in Allahabad High Court as very high. The court said that the judges there are hearing hundreds of cases every day, but despite this the pressure of pending cases remains very high.
The court suggested to the Chief Justice and Administrative Committee of Allahabad High Court that a system should be made to give a pre-fixed date for the hearing of bail petitions.
Court said- include the victims in the hearing
The Supreme Court said that it is very important to get the FSL report on time in cases related to Narcotic Drugs (NDPS) Act. The responsibility of investigating officers is also important, especially in cases involving victims. The investigating officer should ensure that the victims get full opportunity to attend the hearing and seek legal help.
The matter came to light during the hearing of a petition challenging an order of the Punjab and Haryana High Court. Earlier on February 4, the Supreme Court had directed all the states to help the High Court in expeditious disposal of bail cases.
About 63 lakh cases are pending in the High Court of the country.
According to the latest data released by the government, there are 90,897 cases pending in the Supreme Court, 63,63,406 cases in the 25 High Courts of the country and 4,84,57,343 cases in the lower courts. These figures are till December 8, 2025. However, exact data of bail petitions is not available. According to Daksh database, every year more than 4 to 4.30 lakh bail petitions are filed in the High Court of the country.
