The Supreme Court on Friday rejected Congress leader Pawan Kheda’s demand for increasing the transit anticipatory bail. The court said that they should file their petition in the Assam court. Abhishek Manu Singhvi argued on behalf of Pawan Kheda. He said- The courts of Assam are closed, so they should be given a few days’ time. Am I a criminal, that I can’t even get this much relief? The bench of Justice JK Maheshwari and Justice Atul S Chandurkar rejected this demand. The court also reprimanded him for giving wrong documents. This case is related to the allegations against Riniki Bhuyan Sharma, wife of Assam Chief Minister Himanta Biswa Sarma. On April 5, Kheda had alleged that he had more than one passport and properties abroad, which were not mentioned in the election affidavit. Kheda gave wrong documents in the court. During the hearing, senior lawyer Abhishek Manu Singhvi, appearing for Kheda, said that the transit bail is ending on Friday, hence it should be extended till Tuesday so that he can file the petition in Assam on Monday. During the hearing, Attorney General Tushar Mehta raised the issue of irregularities in documents. He said that while filing the petition in Telangana High Court, information of different people was given on the front and back of the Aadhaar card. According to him, relief was taken from the High Court on this basis and this is a case of forum shopping. However, the Supreme Court considered the irregularities in the documents to be serious and refused to increase the bail. The court said that Kheda should go to the Assam court and present his case. Had got anticipatory bail from Telangana Court. Earlier on April 10, Telangana High Court had granted one week’s transit anticipatory bail to Kheda, so that he could go to Assam court. The Assam government challenged this decision in the Supreme Court, after which on April 15, the Supreme Court stayed the High Court order.
