For this, the Central Government has prepared draft rules under the Digital Personal Data Protection Act (DPDP), 2023. This draft was released to the public on Friday (January 3).

The Ministry of Electronics and Information Technology said in the notification that people can register their objections and also give suggestions regarding this draft by visiting Mygov.in. People’s objections and suggestions will be considered from February 18.

The system of obtaining parental consent was also mentioned in the draft. This bill was approved by the Parliament about one and a half years ago. According to the notification issued for the draft, the draft of the rules has been issued on the basis of the powers granted to the Center under sub-sections 1 and 2 of Section 40 of the Digital Personal Data Protection Act, 2023.

The system of obtaining parental consent is also mentioned in the rules. It has also been said that parental consent is mandatory for children to use their data in any form. In the Act, companies that collect and use personal data are called ‘data fiduciaries’.

According to the draft, data fiduciary companies will have to ensure that parental consent is obtained before processing any personal data of children. For this the company will have to take appropriate technical and organizational measures.

The company will be able to keep the data only for as long as the people have given consent. According to the draft, the companies responsible for the data will have to check that the person claiming to be the parent of a child is an adult and if required to comply with any law, identify him. Can go.

According to the draft, these data companies will keep this data only for the period for which people have given them consent. After this they will have to delete this data. E-commerce, social media and gaming platforms will fall into the category of companies responsible for data.

DPDP law was passed in October, 2023 The Digital Personal Data Protection (DPDP) Act was passed by Parliament in October 2023. After the implementation of this law, people got the right to ask for details about their data collection, storage and processing.

It became necessary for companies to tell what data they are taking and what they are using the data for. There was a provision to impose a fine of up to Rs 250 crore on those who violate the law. In the old bill it was up to Rs 500 crore.

The purpose of the bill is to protect people’s privacy After its passage from the Rajya Sabha, IT Minister Ashwini Vaishnav had said, ‘The purpose of this bill is to regulate the processing of personal digital data, so that people’s privacy can be protected. This bill is pro privacy and pro citizen. He said that the bill has not been made too prescriptive, so that changes can be made with time.

However, the opposition had opposed the bill when it was presented in the Lok Sabha. Then a demand was raised to send it to the parliamentary committee.

What is digital personal data? Let us understand digital personal data with an example. When you install a company’s app on your mobile, it asks you for many types of permissions, which include access to things like camera, gallery, contacts, GPS and other things. After this the app can access your data as per its convenience.

Many times these apps upload your personal data on their servers and then sell it to other companies. Till now we are not able to get information from the app as to which data they are taking from us and what they are using it for. This bill has been brought to protect such data.
