The Madhya Pradesh government claims that it has become the first state in the country to constitute a board under the provisions of the Waqf (Amendment) Act-2025. The new board has a total of 10 members. Earlier, under the Waqf Act-1995, the members of the State Waqf Board were only from the Muslim community.
Although some members were nominated by the state government, they too were required to be Muslims. After the amendment in the law in 2025, for the first time it was provided that every State Waqf Board will have at least two non-Muslim members.
Najma got appointment on tenure basis
The name of Najma Heptulla has been included on the basis of earlier tenure, whose tenure is till April 2028. According to the notification issued in the Madhya Pradesh Gazette (Extraordinary) on July 4, 2026, the state government has formed this formation in exercise of the powers conferred under Section 13(1) of the Waqf Act.
Provision has also been made for two non-Muslim members in the Central Waqf Council. Under this change, for the first time in Madhya Pradesh, two Hindu members have been included in the board. The state government announced the formation of the board under Section 13(1) of the Waqf Act in a Gazette (Extraordinary) notification issued on July 4, 2026.
The name of former Union Minister Najma Heptulla has been retained on the board on the basis of her already ongoing tenure. His tenure will last till April 2028. The government says that efforts will be made to strengthen transparency and good governance in the management of Waqf properties through the new board.
What is Waqf Board, what does it do?
Waqf is property which a Muslim person or institution donates permanently for the purpose of religious, educational or social welfare. This may include mosques, cemeteries, dargahs, Idgahs, madrassas, charitable buildings, land or other immovable properties.
- To prepare and preserve records of Waqf properties of the State.
- To monitor the use and income of Waqf properties.
- To protect the interests of Waqf properties in case of illegal occupations or disputes.
- To ensure the utilization of income from Waqf for religious, educational and social welfare purposes.
- To monitor the administration and management of Waqf institutions.
The central government had implemented the Waqf Amendment Act last year.
In the year 2025, the Waqf Amendment Bill (now the law) was passed in the Lok Sabha on 2 April and in the Rajya Sabha on 3 April after 12 hours of discussion. After this, President Draupadi Murmu approved the bill late on the night of 5 April. The government had implemented the Waqf Amendment Act across the country from April 8. On July 3, 2025, the Central Government issued the notification of Unified Waqf Management, Empowerment, Efficiency and Development Rules, 2025, after which this law was implemented in the entire country.
