Serious questions have been raised on the investigation of Delhi Police in the ‘Floris Stay’ hotel fire incident in Malviya Nagar, Delhi. Civil society, social workers and common people allege that 65-year-old hotel cook Keshav Singh Negi is being made a ‘scapegoat’ to save influential hotel owners, Municipal Corporation of Delhi (MCD) and police officials.

In this horrific accident that took place on June 3, a total of 23 people, including 8 members of the Aggarwal family and 15 foreign nationals from Nigeria, Kyrgyzstan, Mozambique, Uzbekistan, Bangladesh, Congo, Liberia and Iraq, have died. Apart from this, more than 30 people are seriously injured.

Police have imposed 5 serious criminal sections on Keshav

Police allege that when the fire broke out, cook Keshav had closed the door and the electric switch and ran away. The police have imposed 5 serious criminal sections on him and sent him to judicial custody for 14 days, which is now being opposed all around.

People say that the main responsibility for ignoring safety standards and lapses in the hotel lies with the management and owners and not with any ordinary employee working there.

The hotel continued to operate for 2 months even after the license expired

Renuka Gupta, former chairperson of MCD’s City Zone, raised questions over the officers responsible for the hotel accident not taking action under culpable homicide (section 105) and not arresting them. He held building department engineers responsible for the 20 illegally constructed rooms and questioned the role of the Delhi Tourism Development Corporation (DTDC) in allowing the hotel to function even after its license expired in March.

Ignoring Form C rules, questions on police working style

Sardar Inderjit Singh Nirman of Gurdwara Management Committee has made serious allegations against the local police in this matter and raised big questions on their working style. He said that every hotel or guesthouse hosting foreign nationals is required by law to submit ‘Form C’ within 24 hours. It is the responsibility of the local police to keep records of foreign guests and keep an eye on them, so that no one remains suspicious.

SDM admitted that a major accident was averted due to power cut

Civil society says that the arrest of Keshav Negi is completely wrong. Five sections including Section 105 (culpable homicide not amounting to murder) of the Indian Justice Code have been imposed on him. It is a non-bailable offence, punishable with imprisonment up to 10 years. Section 105 applies when someone knows that his act may cause death.

Police claim that switching off the electricity after the fire caused darkness, which led to the loss of lives. But, Keshav Negi showed caution by following the rules of fire fighting. Mamgani said he has been a civil defense volunteer and has received training in fire fighting, rescue and emergency measures, adding that switching off electrical connections is the first step in fire safety.

Local SDM Jitendra Kumar himself has admitted that a major accident was averted due to timely switching off of electricity. Civil defense experts also believe the same.
