America has made major changes in the H-1B visa process. Now the beneficiaries will be selected on the basis of salary instead of random lottery. For this, the US Immigration Agency has created a new system of Form I-129, which will be made mandatory from April 1, 2026. Companies will have to provide job related information in the petition filed for foreign employees. This will increase the chances of more experienced and higher paid professionals getting visas than before. In the new system, applicants will be divided into four salary levels. The higher the salary level of the post, the more chances he will get in the selection process. For example, a Level-4 candidate will get four chances, while a Level-1 candidate will get only one chance. Form I-129 is used to bring temporary workers to the United States. The US Department of Labor sets a standard wage for every occupation and city. On the basis of that, the job is kept from Level-1 to Level-4. Indians get 70% of H-1B visas. Trump’s sometimes yes, sometimes no attitude on H-1B. Trump’s attitude on H-1B visas has been sometimes yes, sometimes no in the last 9 years. In his first term in 2016, Trump had called this visa against American interests. The extension of this visa was suspended in 2019. Just last month, he took a U-turn and said – We need talent. You will get the right to stay forever in Gold Card. Apart from the changes in H-1B, Trump had launched 3 new types of Visa cards. Facilities like ‘Trump Gold Card’, ‘Trump Platinum Card’ and ‘Corporate Gold Card’ have also been launched. Trump Gold Card (worth Rs 8.8 crore) will give the person the right to unlimited residency (stay forever) in America. Tech companies sponsor the most H-1B. India produces millions of engineering and computer science graduates every year, who play a big role in America’s tech industry. Companies like Infosys, TCS, Wipro, Cognizant and HCL sponsor most of their employees on H-1B visas. It is said that India exports more people i.e. engineers, coders and students to America than goods. Now due to expensive fees, Indian talent will move towards Europe, Canada, Australia and Middle East countries.
