25 June: The High Court had granted bail to the minor on 3 grounds…
1. The High Court said- the age of the accused is less than 18 years, it is necessary to keep that in mind The aunt of the accused boy had filed a petition in the Bombay High Court for his release. In this petition, it was said that the boy has been detained illegally. He should be released immediately. Justice Bharti Dangre and Manjusha Deshpande had cancelled the order of the Juvenile Justice Board to send the accused to observation home.
The bench had also noted that the order of the Juvenile Justice Board was illegal and was issued without jurisdiction. Amidst the reaction to the accident and public anger, the age of the accused minor was not taken into account. CCL is below 18 years of age, it is important to take her age into consideration.

2. Court said- Minor accused cannot be treated like big accused The court had said that we are bound by the law and the purpose of the Juvenile Justice Act and we have to deal with the accused in the same way as we would deal with any other child who violates the law. No matter how serious the crime is. The accused is undergoing rehabilitation, which is the main objective of the Juvenile Justice Act. He is also taking advice from a psychologist and this will continue in future as well.
3. The court had said- the accused is also in shock after the accident During the hearing, the court had said that it is true that two people died in this accident, but it is also true that the minor child is also in shock. The court had also asked the police on the basis of which rule the Juvenile Justice Board had changed its bail order. The bench had noted that the police had not filed a petition in any higher court against the bail order of the Juvenile Board.
Regarding this, the court asked what kind of remand is this? What power is used behind this remand? What is this process in which a person is ordered to be sent to custody after getting bail.
The minor was granted bail but now he has been kept in an observation home. Isn’t this like taking him hostage? We want to know what power you used to take this step. We thought that the Juvenile Justice Board would act responsibly.
