Delhi Police on Sunday filed a non-cognizable report against unidentified persons for allegedly threatening a magistrate during the bail proceedings of Cockroach Janata Party (CJP) leaders Saurav Das and Ashutosh Ranka. According to officials, the identity of the people who issued threats in the case has not been revealed yet.

This matter has come to light at a time when CJP had alleged that the release of the two leaders was being ‘delayed’ and four sureties attached to the bail had been rejected for ‘unclear reasons’. Non-cognizable reports are generally filed in cases where the police cannot arrest the accused without a warrant and cannot investigate without the permission of the magistrate.

CJP’s legal head Ratna Singh posted on Twitter that she was present at the police station since 11 am for the hearing scheduled at 12 noon, but the Assistant Commissioner of Police, who also serves as the Special Executive Magistrate (SEM), had not reached there till 4.42 pm. He described the SEM Court proceedings as ‘complete misuse of powers’.

Was sent to judicial custody for 5 days

Saurav Das and Ashutosh Ranka Was sent to judicial custody for five days on October 14. Both of them reached there by crossing the closed gate of Jantar Mantar, although Jantar Mantar was not notified as a protest site.

Ratna Singh told that later the magistrate said that someone had threatened her. He said that the lawyers had demanded the magistrate to take action against the person who made the threat and to record his number and name in the order. There has been no response from the police on these allegations. Earlier on Saturday, CJP had said that he had taken advice from senior lawyer Kapil Sibal and had warned of legal action if the two leaders were not released by Sunday. CJP is protesting against Chief Election Commissioner Gyanesh Kumar and Special Intensive Revision of Voter List i.e. SIR.
