With this decision of the court, former CM Mamata Banerjee will get the right to spend the crores of rupees present in TMC’s account under the supervision of the court.

A single bench of Justice Saugata Bhattacharya of the Calcutta High Court has appointed retired Justice Subrata Talukdar as the special officer. Justice Subrata Talukdar will authorize the expenditure only on the basis of checks signed by two Trinamool Congress officials as per the court order.

On Thursday, the Calcutta High Court said that this interim measure will remain in effect till September 30.

Calcutta High Court According to this, TMC will be able to spend the money withdrawn from this account to meet the expenses of running the party. According to the High Court, the special officer will not allow any other kind of expenditure.

While allowing limited transactions in TMC’s bank accounts, the Calcutta High Court said that the court was not satisfied with the evidence shown by the police to order freezing the accounts.

The High Court said that at this interim stage it did not find any concrete evidence that could justify the police’s decision to freeze the accounts immediately after the FIR was registered.

The bench said, “The FIR was filed on June 18 and the accounts were hastily frozen on June 19. At this stage, the court did not find any evidence to show what was the basis for such sudden steps.”

The court also made it clear that this interim arrangement would not amount to recognition of any faction as the “real” Trinamool Congress; This matter is still pending with the Election Commission.

According to a report by Live Law, senior advocate Abhishek Manu Singhvi, appearing for TMC, argued that the debit freeze almost paralyzed the functioning of a recognized political party and violated its constitutional rights.

He said the complaint was vague, lacking any concrete allegations linking the accounts to proceeds of crime, and pointed out that all party funds are regulated under Election Commission rules and the Income Tax Act.
